“Muslim Women and Marriage in Trans-jurisdictional Contexts”

Speaker: Dr Prakash Shah, Queen Mary, University of London

How do immigration officials and judges manage when judging the validity of acts of marriage solemnisation, which take place on transjurisdictional terms? How do we explain their responses? These are some questions raised by this paper, which presents evidence gleaned from the writer’s
own work as an ‘expert’ witness in immigration cases. Two case studies have been selected on the basis that the chief issue in contestation is the validity of a trans-jurisdictional marriage among South Asian Muslims, and therefore raise the issue of whether the marriages are valid according
to Muslim law. The paper also raises some questions for future research, given that we know little as yet about how recognition of minority transjurisdictional marriages takes place across European legal systems and, in particular, the role of experts who get involved in the legal processes in which such marriages are contested.

Women's Asylum News

We recently received a significant donation of back issues of the journal entitled "Women’s Asylum News." The donation consisted Issues 49 (Feb 2005) through to Issue 74 (April 2008). This donation was very kindly given to us by the Refugee Women’s Resource Project @ Asylum Aid and supplements the back issues of this journal that we already held so we now hold an almost complete run from 2002 (Issue 20) onwards.

Committee on the Elimination of Discrimination against Women (40th session): Concluding Observations

For your information, we attach the concluding observations adopted by the Committee on the Elimination of Discrimination against Women at its fortieth session held from 14 January to 1 February 2008 in Geneva, in respect of reports submitted by 8 States parties. The documents are provided in advance unedited version and in the original language of adoption. Women and Asylum

The Information Centre about Asylum and Refugees in the UK (ICAR) has just released a new briefing paper entitled Women Refugees and Asylum Seekers in the UK. This briefing paper is available to download from the ICAR website and further details can be found at:

ICAR state that "This briefing addresses four key issues relating to refugee women: the introduction of gender guidelines, female genital mutilation (FGM), the trafficking of women and women in detention. The briefing aims to complement ICAR’s Navigation Guide on Women Asylum Seekers and Refugees in the UK, which provides a broader overview of this subject."
